USDOT has issued a Notice of Proposed Rulemaking (NPRM) in the Federal Register to modify the "common grant" rule geographic preference provision as it is applied to U.S. DOT programs. On Wednesday, April 8, U.S. DOT announced that they would be extending the comment period to May 6, 2015. While federal contracting rules have traditionally prohibited contract provisions that do not relate to work performance, such as provisions that may be based on social or economic initiatives, including local and other geographic-based labor hiring preferences, the NPRM would permit recipients and subrecipients of federal funds administered by the USDOT to impose geographic-based hiring preferences not otherwise prohibited by federal statute.

Federal Transit Administration (FTA) Announces Public Comment on Interim Policy Guidance for the Capital Investment Grant (CIG) Program
On Wednesday, April 8, the FTA announced they would be inviting public comment on interim policy guidance the agency is proposing for the CIG program. If adopted, the FTA would provide a deeper level of detail about the methods for applying the project justification and local financial commitment criteria for rating and evaluating New Starts, Small Starts, and Core Capacity Improvement projects, and the procedures for getting through the steps required by law.
