The Federal Transit Administration (FTA) is posting requests for comment on selected Buy America waiver requests. Any responsive comments should be sent to: Joseph.Pixley noting "comment on …" in the subject line. The comments must be sent by the stated deadline in order to be considered. Although public comment is not required, FTA hopes by this process to better access industry and grantee knowledge.

REQUEST FOR COMMENTS ON waiver requests by Mars Electronics International and Toyocom, U.S.A., Inc.

Comments are due by close of business Thursday, October 17, 2002.

Two manufacturers of bank note handling units (BHU), which are used in ticket vending machines, have requested non-availability component waivers under the Buy America provisions. These two companies are Mars Electronics, Inc. (MEI) and Toyocom U.S.A., Inc. (Toyocom). The BHU’s at issue are distinguished by their ability to return inserted bills when a transaction is not completed. Both MEI and Toyocom assert that they, along with only one other company in the world (Geiseke & Devirant of America), produce equivalent BHU equipment. Neither MEI, Toyocom, nor G&D manufacture BHU’s in the U.S.

MEI specifically requests that FTA renew a non-availability waiver for BSN385/39, BNA52/54, and BNA57 model BHU’s. FTA last granted a waiver for these items in July 2000, for two years. MEI asserts that there are no U.S. manufacturers of equivalent products. Please Comment.

Toyocom specifically requests that FTA grant a non-availability for its BV-6000 model BHU. Toyocom has provided supporting documentation from Genfare GFI (GFI), a manufacturer of ticket vending machines, supporting their assertion that there are no U.S. manufacturers of equivalent BHU equipment. Please Comment.
