APTA Process For Key SAFETEA-LU Rulemakings

With the Safe, Accountable, Flexible, Efficient Transportation Equity Act - A Legacy for Users (SAFETEA-LU) enacted into law on August 10, 2005, focus now turns to implementing the many policy provisions in the new law. The Federal Transit Administration (FTA) estimates that some 15 new rulemakings will be required by various provisions of SAFETEA-LU and has informally identified the following rulemakings as a priority: new starts/small starts; planning; Buy America; and charter bus.

The purpose of this memorandum is to explain to the APTA membership the process that will be used for developing APTA comments on each of these priority rules. Information on the substance of each rule may be found at www.apta.com at SAFETEA-LU Resource Center under Government Affairs. I urge all interested APTA members to participate in the rulemaking processes.

Small Starts/New Starts

FTA plans to issue an Advanced Notice of Proposed Rulemaking (ANPRM) on small starts in January/February 2006; the purpose of such an ANPRM is to seek early comments from stakeholders. The results will be incorporated into a Notice of Proposed Rulemaking, which will address small starts and new starts, that FTA plans to issue in the late spring of 2006 with a final rule expected in 2007.

APTA's Policy and Planning Committee, through its Major Capital Investment Subcommittee, has played a key role in developing APTA's policies and positions on New Starts issues in coordination with the New Starts Working Group, and will continue to do so in connection with SAFETEA-LU small and new starts rulemakings.

The results of small starts listening sessions held at the APTA Annual Meeting will be incorporated into a Transit Cooperative Research Program Quick Response white paper requested by APTA; the study will frame the options for simplified criteria for a small starts program. KEY SAFETEA-LU RULEMAKINGS 2

Planning

The new planning provisions are to be jointly implemented by the Federal Highway Administration (FHWA) and FTA in the form of regulations and guidance; the regulations could take up to a year to be developed for public comment. APTA's Policy and Planning Committee will, as in the past, have the lead in developing APTA's comments in coordination with other appropriate APTA committees. FTA staff briefed the committee on SAFETEA-LU planning provisions during the APTA Annual Meeting and held a listening session on implementing the provisions. On September 2, FTA and FHWA issued interim guidance for implementing SAFETEA-LU provisions on planning, environment, and air quality. The guidance is posted on the APTA web site under SAFETEA-LU Resource Center. Buy America

FTA is expected to act soon on the Buy America rulemaking since SAFETEA-LU calls for a final Buy America rule no later than six months after its August 10 enactment.

A Buy America Task Force, chaired by former Vice Chair-Government Affairs Richard J. Bacigalupo, was created by the APTA Executive Committee in late 2003 to develop a position on regulatory changes to Buy America. APTA Vice Chair-Government Affairs Christopher P. Boylan has asked Mr. Bacigalupo to continue to chair that task force to develop comments on FTA's Buy America rulemaking. A list of the membership of the task force is attached. Its meetings are open to all members; the task force's first meeting since SAFETEA-LU passed will be December 1, in Washington, DC, in the L'Enfant Plaza Hotel's Lafayette Room from 3-5 p.m. For more information on this rulemaking, please contact Jim LaRusch of APTA's Government Affairs Department at (202) 496-4808 or email jlarusch@apta.com.

Charter Bus

SAFETEA-LU requires a charter bus rulemaking to be developed by means of a negotiated rulemaking process. Under such a process, FTA will set up an advisory committee of public and private sector interests in an effort to reach agreement on the outline of a proposed charter bus rule. FTA plans to collect information on charter bus issues over the coming months, and is likely to issue a Federal Register Notice in January/February 2006 asking interested parties to contact FTA if they would like to participate on the advisory committee. The first advisory committee meeting would likely be around April 2006, with at least six monthly meetings expected thereafter.

An APTA Charter Bus Task Force, chaired by Sandy Draggoo of Capital Area Transportation Authority in Lansing, Michigan, and reporting to APTA's Legislative Committee, has been meeting for a year or so. APTA Vice Chair-Government Affairs Christopher P. Boylan has asked Ms. Draggoo and the task force to continue its work in connection with this FTA rulemaking. The APTA staff has indicated to FTA that it will submit the names of its task force members to be on the advisory committee, and FTA appears willing to accept all of the task force members on the advisory committee. Others are free to apply to be on the committee. A list of the membership of the task force is attached.
