Waiver:  Remaining Federal Interest in Proterra Buses

Description:  The Federal Transit Administration (FTA) is aware of operational challenges with buses built by Proterra. Following Proterra’s filing for Chapter 11 bankruptcy, Phoenix Motorcars (now PhoenixEV) completed its acquisition of Proterra’s Transit Division in January 2024, including assuming responsibility for some Proterra warranties. FTA is aware many agencies have struggled with parts availability and warranty support. For large, heavy-duty transit buses, FTA requires recipients to operate and maintain federally funded buses for at least 12 years of service or an accumulation of at least 500,000 miles. The purpose of this letter is to provide instructions for any FTA recipient considering retiring their Proterra buses early and requesting a waiver of the remaining useful life and the remaining Federal interest in the vehicles. This process is only applicable to Proterra buses where certain conditions are met. FTA will perform a uniform review of each request.
