Rule/Notice/NOFO: OMB, Final Guidance for Grants and Agreements
Federal Register/Notice: federalregister.gov
Type of Requirement: Final Rule
Description: OMB is revising its guidance in title 2 of the CFR to add a new part 184 and revise 2 CFR 200.322. The revisions implement the requirement to issue guidance to the head of each Federal agency to assist in the implementation of the requirements of the Build America, Buy America Act (BABAA). The new part 184 of 2 CFR provides clear and consistent guidance to Federal agencies about how to apply the domestic content procurement preference as set forth in BABAA to Federal awards for infrastructure projects.
How is it enforced by FTA, DOT, Direct grant requirement, triennial review or other? FTA enforces Buy America compliance through its triennial review process.
Is there a cost or time impact to grantees (best estimate): APTA believes that there may be costs associated with complying with this new guidance.
