Description: OMB is proposing to revise OMB Guidance for Grants and Agreements. The proposed revisions are limited in scope to support implementation of the Build America, Buy America Act provisions of the Infrastructure Investment and Jobs Act; and to clarify existing requirements. These proposed revisions provide further guidance on implementing these statutory requirements and improve Federal financial assistance management and transparency.
How is it enforced by FTA, DOT, Direct grant requirement, triennial review or other? FTA enforces Buy America through its triennial review program.
Is there a cost or time impact to grantees (best estimate): APTA submitted previous comments regarding OMB’s guidance on construction materials. Adding to the list could exacerbate problems with getting suppliers and sub-suppliers to identify domestic content. Also, OMB/DOT did not respond to APTA’s suggestions to create a national database with Buy America compliant suppliers.
